Terms of Use

These Terms of Use ("Terms") govern your use of the MyTradAI iOS application and the website mytradai.com (together, the "Service"), operated by MyTradAI ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What the Service is — and is not

• MyTradAI generates AI-powered stock analysis and chart analysis reports.
• The Service does not place trades, execute orders, hold positions, manage money, or connect to any brokerage account.
• Nothing in the Service constitutes investment, financial, legal, or tax advice, or a personalized recommendation to buy, sell, or hold any security.
• AI-generated content can be incomplete, outdated, or wrong. Market data and news are sourced from third parties and may contain errors or delays.

2. Eligibility and accounts

• You must be at least 13 years old (or the minimum age in your jurisdiction) to use the Service.
• You sign in with Apple or Google. You are responsible for activity on your account and for keeping access to your sign-in method secure.
• One free-tier allowance applies per person/device. Circumventing quotas (e.g., by creating multiple accounts or resetting device identifiers) is prohibited.

3. Subscriptions and billing

• The free tier includes a limited number of analyses per day. Paid auto-renewable subscriptions (Chart Analysis, Stock Analysis, and All-Access) unlock unlimited runs and, for All-Access, the most capable AI model.
• Subscriptions are billed through your Apple ID via the App Store. Payment is charged at confirmation of purchase.
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the period ends.
• You can manage or cancel subscriptions any time in your device's Settings → Apple ID → Subscriptions. Deleting the app does not cancel a subscription.
• Refunds are handled by Apple under App Store terms; we cannot issue App Store refunds directly.
• Prices may change; changes apply to renewal periods after notice as required by the App Store.

4. Acceptable use

You agree not to:

• Resell, redistribute, or provide the Service's output as your own commercial data or advisory product;
• Reverse engineer, scrape, overload, or interfere with the Service or its API;
• Use the Service for any unlawful purpose, including market manipulation;
• Attempt to extract our prompts, models, or server-side keys;
• Circumvent quotas, entitlements, or security measures.

We may suspend or terminate accounts that violate these Terms.

5. Intellectual property

The Service, including its design, software, prompts, and branding, is owned by MyTradAI and protected by law. We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on Apple-branded devices you own or control, as permitted by the App Store terms. Reports generated for you may be used for your personal, non-commercial purposes.

6. Third-party content and services

The Service embeds and relies on third-party services, including TradingView charts, market data and news providers, and AI model providers (Google Gemini, Anthropic Claude). Their content is provided "as is" and remains subject to their own terms. We are not responsible for third-party content, accuracy, or availability.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANALYSES WILL BE ACCURATE OR PROFITABLE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYTRADAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY TRADING OR INVESTMENT LOSSES, LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.

10. Apple-specific terms

• These Terms are between you and MyTradAI, not Apple. Apple has no obligation to provide maintenance or support for the app.
• In case of the app's failure to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.
• Apple is a third-party beneficiary of these Terms and may enforce them against you.
• Where these Terms are silent, Apple's standard Licensed Application End User License Agreement applies.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access for violation of these Terms or to protect the Service. Sections that by their nature should survive (disclaimers, limitations of liability, IP) survive termination.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced in the app or on this page, and the "Last updated" date will change. Continued use after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws applicable in our place of establishment, without regard to conflict-of-law rules, and subject to any mandatory consumer protections of your country of residence.
